Description

Extracted from FOI no. FNR-2018-86147. A comprehensive series of agreements between Blackcomb Mountain and the province that culminates in the provision of two free public access corridors through the Blackcomb CRA.

The process begins with a letter from the Minister of State Responsible for Parks, the Hon. Terry Huberts to Hugh Smythe, president of Blackcomb Skiing Enterprises Ltd. dated August 9, 1989. In the letter, the minister stipulates that the deletion of lands from Garibaldi Park and expansion of the mountain operations to Blackcomb Glacier and Blackcomb Creek is part of an overall action that ensures "free and unrestricted access" to Garibaldi Park that borders the area.

A map is provided by Hugh Smythe to the Ministry of Parks, dated November 8, 1989. The map shows two access routes from village to alpine. One is categorized as year round up Blackcomb Creek, numbered 1. The second, up Gondola Road and Sunset Boulevard, numbered 2, is categorized as a summer route to Blackcomb Lake.

An amendment to Blackcomb's development agreement is made on March 11, 1991 designating the Blackcomb Glacier access route with a width not less the 16.5 feet. The agreement is binding on all successors and assigns of the parties.

On April 22, 1991, Crown Lands informs Blackcomb that BC Parks wants to secure a second public access route and that the amending agreement will be held in abeyance until Blackcomb reaches agreement with BC Parks.

On the same day, Blackcomb agrees to the second access route, the one described as number #2 up Gondola Road to Sunset Boulevard, Southern Comfort to Ziggy's Meadow and then into the park.

On July 24, 1991, Crown Lands informs Blackcomb that both routes are incorporated into Blackcomb's development agreement.
